Terms & Conditions

By The Hour Bartending

By booking services with By The Hour Bartending, you agree to the following Terms & Conditions. Please read them carefully.


1. Services Provided

By The Hour Bartending provides professional bartending services for private events, weddings, corporate events, and other special occasions. We supply trained bartenders only unless otherwise specified in writing.

Alcohol, mixers, ice, cups, and bar equipment are not included unless explicitly stated in your booking agreement.


2. Booking & Payment

  • A booking is not confirmed until payment is received.

  • Full or partial payment may be required to secure your event date.

  • Payments are processed securely via Stripe or approved payment methods.

Failure to complete payment may result in loss of reservation.


3. Cancellations & Refund Policy

  • Cancellations made 7 days or more before the event may be eligible for a refund, minus any non-refundable processing fees.

  • Cancellations within 7 days of the event are non-refundable.

  • Same-day cancellations or no-shows are non-refundable.

Refund eligibility may vary depending on staffing and scheduling commitments already made.


4. Event Changes

Any changes to event details including date, time, location, or guest count must be communicated at least 72 hours before the event.

Last-minute changes may result in additional fees or inability to accommodate the request.


5. Event Duration & Overtime

Service time begins at the scheduled start time agreed upon during booking.

Overtime is subject to bartender availability and will be billed at the agreed hourly rate. Overtime must be paid before or immediately after the event.


6. Client Responsibilities

The client agrees to:

  • Ensure all guests are of legal drinking age.

  • Provide a safe, legal environment for alcohol service.

  • Obtain any required permits or permissions for alcohol service.

  • Prevent intoxicated guests from driving.

By The Hour Bartending reserves the right to refuse service to any guest who appears intoxicated or disruptive.


7. Alcohol Liability

By The Hour Bartending and its bartenders are not responsible for:

  • Guest intoxication

  • Injuries or damages caused by guests

  • Alcohol consumption beyond legal or safe limits

The client assumes full responsibility for alcohol-related risks at the event.


8. Insurance & Compliance

By The Hour Bartending maintains general liability insurance. Proof of insurance may be provided upon request.

We comply with applicable state and local alcohol service laws.


9. Force Majeure

We are not liable for failure to perform services due to events beyond our control including but not limited to:

  • Severe weather

  • Natural disasters

  • Government restrictions

  • Emergencies or acts of God

In such cases, rescheduling options may be offered when possible.


10. Media & Marketing

By booking our services, you grant permission for By The Hour Bartending to use event photos or videos for marketing purposes unless explicitly requested otherwise in writing.


11. Limitation of Liability

Our liability is limited to the amount paid for services. We are not responsible for indirect, incidental, or consequential damages.


12. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the state where the event takes place.


13. Agreement

By submitting payment or confirming a booking, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.


SMS & Messaging Consent 

By providing your phone number to By The Hour Bartending, you expressly consent to receive text messages (SMS/MMS) related to our services. These messages may include but are not limited to:

  • Quote confirmations

  • Booking confirmations

  • Appointment or event reminders

  • Follow-up messages regarding your inquiry

  • Service-related updates and notifications

Message frequency may vary depending on your interaction with us.


Opt-In & Consent

  • By submitting your phone number through our website forms, quote forms, booking forms, or other communication channels, you opt in to receive text messages from By The Hour Bartending.

  • Consent is not a condition of purchase.

  • Messages may be sent using an automated system in compliance with A2P 10DLC regulations.


Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying:

STOP

Once you opt out, you will no longer receive text messages unless you re-opt in.


Message & Data Rates

Standard message and data rates may apply based on your mobile carrier and plan. By The Hour Bartending is not responsible for carrier charges.


Privacy & Data Use

Your phone number and messaging data will be used only for communication related to your inquiry, booking, or services.

We do not sell, rent, or share your phone number with third parties for marketing purposes.

Supported Carriers

Messaging services are supported by most major U.S. carriers. Delivery is subject to carrier availability and network conditions.


Service Availability

SMS messaging may not be available at all times and is not guaranteed for emergency communication.
