Agreement to Terms

These Terms of Service constitute a legally binding agreement between you ("Client") and By The Hour Bartending LLC ("Company," "we," "us"), a limited liability company headquartered at 8711 E Pinnacle Peak Road #237, Scottsdale, AZ 85255. By requesting a quote, making a payment, or using our website, you agree to be bound by these terms.

If you are booking on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

Our Services

By The Hour Bartending LLC provides professional mobile bartending services for private events, including but not limited to weddings, corporate events, birthday parties, anniversary celebrations, and other gatherings. Our services include:

• TIPS and RBS-certified bartenders for the agreed service period
• Professional bar tools and equipment (excluding a physical bar structure)
• A complimentary custom alcohol shopping list based on your event details
• Optional add-on services as selected during the booking process

We do not supply alcohol, mixers, ice, cups, or garnishes unless specifically agreed in writing. These items remain the Client's responsibility.

Booking and Confirmation

A booking is considered confirmed only after a deposit or full payment has been received. Submitting a quote request or receiving a quote does not constitute a reservation. Event dates are held on a first-paid basis.

You are responsible for ensuring all event details (date, location, start time, guest count, services) are accurate at the time of booking. Changes must be requested in writing at least 14 days before the event. We will make every reasonable effort to accommodate changes, though additional charges may apply.

Payment Terms

Our standard rates are $69 per hour per bartender and $59 per hour per bar back or server. A minimum booking of 3 hours applies to all events.

Payment options:

• 25% Deposit: Secures your date. The remaining 75% balance is due 14 days before the event.
• Full Payment: Pay 100% at time of booking at your option.

All payments are processed securely through Stripe. We accept all major credit cards, debit cards, Apple Pay, and Google Pay. Returned payments or failed charges may result in a service hold and applicable processing fees.

Prices quoted are valid for 30 days from the quote date. We reserve the right to adjust pricing for bookings made after that period.

Cancellations and Refunds

We understand that plans change. Our cancellation policy is straightforward:

• Deposit payments: The 25% deposit is non-refundable in all circumstances. It compensates for the date reservation, bartender scheduling, and administrative work completed on your behalf.
• Full payment cancellations: If you have paid in full and cancel at any time before the event, you are eligible for a 75% refund of the total paid. The remaining 25% is retained as the non-refundable deposit equivalent.
• Date changes: We will work with you to reschedule at no additional fee, subject to bartender availability. Date change requests must be made at least 7 days in advance.
• Same-day cancellations: No refund is available for cancellations made on the day of the event.

In the rare event that we are unable to fulfill your booking due to circumstances on our end, you will receive a full refund of all amounts paid.

Client Responsibilities

To ensure a smooth event, clients agree to:

• Provide a safe, accessible, and adequately lit workspace for the bartending team
• Have all alcohol, mixers, ice, and supplies ready at the venue before the bartender's arrival
• Ensure that all guests consuming alcohol are of legal drinking age (21 in the United States)
• Notify us in advance of any venue-specific rules, permits, or Certificate of Insurance requirements
• Treat our staff with respect — we reserve the right to end service without refund if our team is subjected to harassment, threatening behavior, or unsafe conditions

Alcohol Service and Compliance

All our bartenders are TIPS and RBS certified in responsible alcohol service. They are authorized and trained to:

• Verify the age of guests using valid government-issued identification
• Refuse service to visibly intoxicated individuals
• Refuse service to anyone who cannot provide valid ID

The Client acknowledges that alcohol service at private events is subject to applicable federal, state, and local laws. The Client is responsible for obtaining any permits required by the event venue or local jurisdiction. By The Hour Bartending LLC carries $2 million in general liability insurance, which does not substitute for any permits required of the event host.

We do not hold a liquor license and do not sell or provide alcohol. All alcohol is purchased and owned by the Client.

Limitation of Liability

To the fullest extent permitted by Arizona law, By The Hour Bartending LLC's total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the Client for the specific event giving rise to the claim.

We are not liable for:

• Indirect, incidental, or consequential damages of any kind
• Damages caused by the actions of intoxicated guests after service has ended
• Loss or damage to the Client's property unless caused by our gross negligence
• Delays or cancellations caused by weather, natural disasters, or circumstances beyond our reasonable control (force majeure)

Indemnification

You agree to defend, indemnify, and hold harmless By The Hour Bartending LLC, its members, employees, and contractors from and against any claims, damages, costs, or expenses (including reasonable attorney's fees) arising out of your breach of these terms, your event, or your failure to comply with applicable laws — except to the extent caused by our own gross negligence or willful misconduct.

Intellectual Property

All content on this website — including text, graphics, logos, photography, and code — is the property of By The Hour Bartending LLC and is protected by United States copyright law. You may not copy, reproduce, distribute, or use our content for commercial purposes without our written permission.

By submitting photos, reviews, or testimonials to us, you grant By The Hour Bartending LLC a non-exclusive, royalty-free license to use that content for marketing and promotional purposes.

Governing Law and Disputes

These Terms of Service are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association.

You waive any right to bring a class action lawsuit against us in connection with our services.

Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes take effect when posted to this page with an updated effective date. For active bookings, the terms in effect at the time of your booking confirmation apply. We will notify clients with upcoming bookings of any material changes.
